At SMARTPOPIA we are committed to protecting the privacy of our clients, employees and service providers. This policy outlines our approach to the collection, use, and protection of personal information in accordance with the Protection of Personal Information (POPI) Act. This Policy is mandated by the introduction and enforcement of the requirements of the following South Africa Regulatory acts:

a) “Protection Of Personal Information Acts” and
b) “Protection Of Personal Information Acts”.

These Acts are more commonly referred to as “PAIA & POPIA”. The reason for the propagation of these acts was to ensure that both Individual (Person) and Juristic Persons (Entities) rights, which are part of The South African Constitution, are upheld. These reference documents and Acts are available to the company employees, contractors and third parties from the Information Regulator website.

In accordance with the “Protection of Personal Information Act (POPI)”, the Company is obligated to maintain a Schedule of records. Public records will be made available by the Information Officer in accordance with the companies Data Protection framework.

Personal Information

The company will only acquire the necessary personal information in accordance with the provisions in the POPIA ACT 2013. These provisions have been implemented in our framework policy and include amongst other..

  • Only the Minimum required Personal Details will be requested/acquired in accordance with the POPI ACT, unless there are other Statuary/Regulatory requirements.
  • The requested/acquired Personal Details will be validated based on the supplied personal details, unless there are other Statuary/Regulatory requirements.
  • No Special or Other defined Personal Information Details will be requested/acquired, unless there are other Statuary/Regulatory requirements.
  • Personal Details might be Shared to ensure the quality of the supplied information and ensure its current and valid.
  • No Personal Details will be Transferred, Unless we have received your permission.
  • The Transfer or Share of Personal Details will be undertaken based on the Third Party ensuring compliancy with the POPI Act, Unless there are other Statuary/Regulatory requirements.

Processing Of Information

The company will only process the necessary personal information in accordance with the provisions in the POPIA ACT 2013. These provisions have been implemented in our framework policy and include amongst other.

  • Only the Minimum required Personal Details will be processed in accordance with the POPI ACT, unless there are other Statuary/Regulatory requirements.
  • The Personal Details will only be processed based on the requirements to undertaken a mutual agreed business transaction between the respective Person/'Juristic Person' and the company.
  • The Personal Details will only be kept as records in our internal systems based on the current Statuary/Regulatory requirements.
  • The company will review annually the current framework. To ensure the development of a active POPIA compliance culture.
  • In the event that Personal Details need to be processed by Share/Transfer of the said details a formal notification will be sent to the respective Person/'Juristic Person' and the company.

Protection Of Information

The Company takes the protection of Personal Information very seriously and will implement appropriate measures to secure the personal information it collects. All personal information shall be stored on secure servers and will only be accessible by authorized personnel for specific, lawful purposes. 

Despite the security measures we have in place to protect your personal information, you acknowledge that even with the Company’s best efforts, your Personal Information may be accessed by an unauthorised third party, e.g. as a result of an illegal activity.
